Our terms and conditions as set out below will apply to all orders you make with us. Please take your time and read these carefully placing any order. By using this site you are agreeing to these terms and conditions
Nothing in these terms and conditions will be deemed to affect your statutory rights
1. IMPORTANT
1.1. All Motorbikes, quad-bikes, go-karts and buggies can be dangerous. You should wear safety equipment such as helmets, shin and elbow pads etc. at all times when using bikes and similar machines. The use of any powered vehicle could involve the risk of injury or death. You should only ever use your bike, kart or buggy in a sensible way.
1.2. The products that we supply are technical and mechanical products, which require mechanical knowledge and skill to use and maintain. You should not purchase our products unless you have a good understanding of how to use and maintain mechanical products. If you are in any doubt about this please telephone us to discuss the product you are thinking of buying. We will be able to guide you as to the level of knowledge required to use and maintain the item you are considering purchasing. If you are in any doubt please contact us on 08448 730307.
1.3. Unless described as 'road legal' the products that we sell are not for use on the public highway. These vehicles are intended to be enjoyed on private property where it is lawful to use them. If you use vehicles which are not road legal on the public highway you will commit a criminal offence and may be subject to criminal proceeding. You must check to ensure that you will be able to use any products purchased from us in a proper and lawful manner and that you have access to facilities to do so. 1.4. Except as set out in clause 11 we will not be held liable for liable for any loss, damage or injury caused arising out of any products that we provide to you.
2. Name of Supplier, Customer and Website Details
2.1. All references to the 'company', 'us' or 'we' in these terms and conditions refer to Funbikes Limited (Company Number 6293682) whose registered office is at 2 Phoenix Court, Lenton Lane, Nottingham NG7 2PU.
2.2. All references to the customer shall mean the person or persons purchasing or agreeing to purchase goods from us.
2.3. All references to the Web Site shall include reference to all URL's owned by us.
3. Prices and VAT
3.1. All prices are shown in pound sterling (£) and are inclusive of UK VAT at the current rate unless clearly stated otherwise. It is our policy to offer goods at the most reasonable price possible, however, if, due to circumstances beyond our control, we deem it necessary to alter any advertised price, we reserve the right to do so without prior notice.
4. Orders
4.1. Your order through our Website will only be accepted by us when process your order by preparing the goods to be sent out to you. Until we process your order in this way there will not be a binding contract between you and us. Any information on our web site, or your filling in details or clicking any button or icon indicating you are making an order does not, and is not intended to, constitute a binding contract between you and us.
4.2. We are pleased to accept orders by any of the following methods.
4.2.1. Online transaction (secure server); or
4.2.2. e-mail (unsecure);
4.2.3. telephone; and
4.2.4. and post.
4.3. All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Maestro, Switch and Solo. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. We are unable to accept or process any credit/debit card orders without a valid card payment in the name of the registered cardholder.
4.4. If you are making payment by cheque then payment should be from a UK bank, with the cheque being made out to "Funbikes Limited", and crossed 'A/C payee only'.
5. Dispatch of Your Order
5.1. All goods are subject to availability.
5.2. Items ordered will be delivered as soon as possible in accordance with the requested delivery service. All delivery charges shown are for 2 to 4 day delivery of items in stock, to U.K. mainland addresses only. Charges for different delivery services can by obtained by contacting us directly.
5.3. All delivery conditions and charges are subject to change without prior notice. Every effort is made to ensure that delivery is made within the estimated time scales and within a maximum of 10 days.
5.4. In the event that we are unable to supply your goods within 28 days, we will inform you and advise you of the expected delivery date.
6. Delivery
6.1. You should check your order carefully when it is delivered to you. In the event of any goods delivered by us being damaged in transit, or failure to match the items ordered by you, then such details must be notified by you to us within 24 hours of receipt. If we receive no such notification you will be deemed to have accepted the items as satisfactory. We use independent couriers in order to deliver goods to you a quickly and efficiently as possible. We need to hear from you as soon as possible if you believe that your order has been damaged in transit so that we can investigate the matter with our couriers.
6.2. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the company's appointed carrier. Liability in such cases is limited to the value of those items, which are shown to have not been received by the customer.
7. Cancellation of Outstanding Orders
7.1. For products listed on our Website outstanding orders can be cancelled at any time. In instances where payment has already been made, an alternative or refund in full for the item(s) concerned will be given.
7.2. If you have requested that we order a particular product, not listed on our Website or held in stock by us (a "personalised order") we will have to order that product especially for you. Once we have ordered the product for you we will not be able to cancel our order with our supplier and would have difficulty in reselling the product to anyone else. As a result you we will not accept cancellation of a personalised order once we have requested product from our suppliers. In such cases we consider that the order has been made to your specification as it is not a product that we normally sell.
8. Returns and Exchanges
8.1. We want you to be entirely satisfied with every purchase made from us and we aim to offer you excellent quality, value and service at all times. An invoice marked paid will be dispatched to you for all purchases. This is your proof of payment. We will consider that an item has been used if you have put fuel in it an either started it or tried to start it.
8.2. If you wish to return an unused item for exchange or you have decided not to keep it, please contact us within 7 days of receipt of item. Returned items must be accompanied by a copy of your paid invoice and, must be accompanied by original packaging.
8.3. We shall not be obliged to exchange product or refund and purchase price in cases where we reasonably consider that you have damaged or misused the item.
8.4. Customers should arrange their own return courier. If, however we are required to arrange pickup and return delivery of an item, the full cost of arranging that service will be deducted from the refunded amount.
8.5. After we have established that the item is unused and undamaged, you will be refunded the entire sales price excluding original cost of delivery, and if applicable, the cost of return service. 9. Products
9.1. Products are sold singly unless otherwise stated. Every effort is made to ensure the colours depicted on the site match as closely as possible those of the actual product. Due to technical limitations, some colours may vary.
10. Warranty - NOT ALL OF OUR PRODUCTS COME WITH A WARRANTY
10.1. No products are supplied with a warranty unless it expressly says so in the description for the product in question on our Website. The length of any warranty offered varies from machine to machine and is specified in the description for the product in question on our Website
10.2. The Following parts are not covered by any warranty offered on our products:
10.2.1. Sprockets;
10.2.2. Chains / Belts;
10.2.3. Fairings and Bodywork;
10.2.4. Pull Starter Inner Cogs;
10.2.5. Brake Callipers;
10.2.6. Exhaust Pipes;
10.2.7. Batteries;
10.2.8. Tyres, valves and Inner Tubes;
10.2.9. Radiators and Engine Hoses;
10.2.10. Spark Plugs;
10.2.11. Any other parts of a similar consumable nature to those listed above; and
10.2.12. Any part that has been damaged as a result of accident damage or lack of maintenance.
10.3. If within any warranty period your machine develops a fault, you must contact us and we will:
10.3.1. advise best course of action to rectify problem.
10.3.2. dispatch parts, without charge, during the first 30 days, providing the parts required are under warranty. Please note customers will be expected to fit parts themselves, guidance will be available on technical issues. If a machine repair is not possible by the customer, we request the product be returned to us, for repair. The product MUST be returned in its original packing box, complete with packing materials OR the customer at his/her own expense can authorise a qualified mechanic to correctly fit the parts.
10.4. If necessary we will agree to collect the machine, effect the repair and return at our cost provided that the repair concerns an item covered by the warranty. If the fault or repair is not covered under warranty, courier charges and labour rates per hour will apply at their then current rate. The machine will not be returned until these charges have been paid by you.
10.5. If you no longer have the original packaging, then it will be your responsibility to return the machine to us, including all carriage costs. No responsibility will be accepted by us for any damage incurred whatsoever during delivery to us of the machine. (Mini Moto's especially do not travel well unless in their original box with the factory protective packing). Once repaired you machine will be boxed with the correct protective packaging and returned to you.
11. Limitation of Liability
11.1. Except for death or personal injury due to our negligence or that of our employees, we shall not in any circumstances be liable, whether in contract or tort, to any customer for any indirect or consequential loss or damage arising from the sale or use of our goods including without limitation loss of profits, damage to property or loss of contracts. In all cases our entire liability, howsoever arising, shall be limited to damages, which shall not exceed the price paid for the goods in respect of which the claim has arisen.
11.2. You must observe and comply with all applicable regulations and legislation concerning the purchase and use of products form our Website, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
11.3. Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
12. Distance Selling Regulations
12.1. You have a right to cancel your order within seven working days following the day after the date of delivery for any unused item purchased by way on online transaction, email, telephone or post under the distance selling regulations for refund. This does not apply to any perishable goods, unsealed software or item personalised or made to your specification.
12.2. To cancel any item, you can e-mail, telephone, or write to us quoting your invoice number. You must take reasonable care of the items, and must not use them. Goods must be returned to us within seven days of your notice to cancel. Items may be returned to us, at the above shown address. All goods are returned at your own expense. Should you require your unwanted goods to be collected, we will deduct the appointed couriers direct costs from the refund given.
12.3. Providing the goods are received back in an unused condition, and with all accessories, you will receive a refund within thirty days of your notice to cancel.
13. Force Majeure
13.1. We will not be liable for non-performances of our obligations caused or resulting from industrial disputes or any other circumstances beyond the reasonable control of the company such as act of God, riots, civil commotion, flood, fire and legislation. If by reason of such circumstances it shall become impossible within a reasonable time for the company to wholly or partly supply the items ordered then the customer's liability will be limited to the value of the items already supplied together with any associated delivery charges.
14. Content
14.1. Any information displayed on our web site(s) or other printed matter by the company is not regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice to other certified codes of practice. All information on our web site is updated regularly.
15. Pricing and Print Errors
15.1. Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions. We reserve the right to alter our prices and specifications without notice.
16. Ownership of Goods
16.1. All items supplied to the customer remain our property until final payment of all sums owing in respect of those goods has been received in full by us.
17. Complaints
17.1. Any complaint can be communicated directly to us. We will endeavour to deal with your complaint within five working days of receipt. In the event where we cannot resolve your complaint immediately we will advise a likely time scale to you and keep you informed of any investigation.
18. Privacy Policy
18.1. This privacy policy covers us and our Web site.
18.2. You can browse our site(s) without disclosing any personal data to us. Any links to third party web sites are covered by the third parties privacy policies.
18.3. We do not automatically log personal data nor do we link information automatically logged by other means with personal data about specific individuals.
18.4. We will collect and store information about you to allow us to firstly, process and fulfil any order requirements and secondly to provide you with the best possible service. We will collect and store any personal data that you may volunteer whist using our services, e.g. (registration, placing an order or requesting a catalogue).
18.5. We will use the data for our own marketing purposes, including market research and to keep you up to date with any offers or information regarding our stores or direct sales channels.
18.6. The type of information that we will collect will include,
