Trading Terms & Conditions.

These terms and conditions apply to the use of this website www.funbikes.co.uk, as well as any order made in store or over the phone with the company.

By accessing this web site, you are agreeing to be bound by the Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by any applicable copyright and trade mark law.

1 INTRODUCTION

1.1 We hold the right to revise and edit these terms and conditions at any time. You should check this website from time to time to review the terms and conditions listed. If at any time you do not agree with the terms listed, you are then prohibited from using this site.


2 SALES

2.1 You can place an order from this site or over the phone with one of our sales representatives. As part of the checkout process you will be given an opportunity to review the order and to correct any errors made. We will then send you an email acknowledgment detailing the order you have place with us.

2.2 We accept the placed order once we have dispatched the order. Your dispatch information will be sent to you via the email address you provide. Once the item has been dispatched the purchase contract has been completed unless we notify you that we do not accept the order, or you cancel the order placed.

2.3 We have the right to refuse any order if:

2.3.1 Goods are not available for dispatch,

2.3.2 Where we cannot obtain authorization for your payment,

2.3.3 There has been a pricing or product description error,

2.3.4 You do not meet any eligibility criteria set out by these terms and conditions


3 PRICING

3.1 All pricing listed on this site includes VAT (where applicable) at the current rate. On your invoice the VAT will show separately, however it will be included in the final price.

3.2 Where we charge a separate fee (carriage, build etc.…) the prices are listed in the appropriate sections on this website.

3.3 Our prices are reviewed periodically and often changed, please check the website for any price changes.

3.4 Our Price Match Guarantee will apply to retail websites of companies based in the United Kingdom and does not apply to 3rd party seller websites. Examples of these are eBay, Amazon and Play. If the item is identical to the one, we are supplying then we are willing to offer 100% of the difference from the item, including any shipping cost that might be included on the other parties’ item.


4 CANCELLATION AND RETURNS POLICY ONLINE AND OVER THE PHONE ONLY

4.1 If you wish to cancel your order:

4.1.1 You can contact us via email at info@funbikes.co.uk or phone on 01664 498 640 and quoting your order reference number; or

4.2 You can notify us of your wish to return the goods to us for a full refund or exchange within the first 14 days of receipt, and a further 14 days are given for the goods to be received at our address. Preferably, the goods should be in the original packaging. The cost of returning the item is yours to bear.

 4.3 Once we have received the item/s back you will receive a full refund or an exchange for credit for the amount paid. All refunds will be repaid into the same account from which payment was made.

4.4 The rights to return your items will not arise if the item/s have been used, damaged, modified or broken. This statement does not affect your statutory rights.

4.5 If any item is returned to us in a non-saleable condition, we have the right to reduce your refund up to the full purchase price.

4.6 Faulty or Damaged Goods: Online, Phone and Store Purchases.

4.7 You take full responsibility on receipt of the items you have ordered. Please contact us as soon as possible if any damage, fault occurs with your item within your warranty period. We may ask you to provide a picture of the damage via email. We will look at sending a replacement part to fix the issue but if a part will not resolve the problem then we will offer a return of the vehicle for a fix. A replacement/refund if deemed damaged beyond repair. A refund will not be offered on any assembly, misuse or wear and tear on the item. Please note that if a replacement is given this will be a refurbished item if the vehicle returned is used.


5 DELIVERY

You can view your estimated delivery time & charges by either clicking the “Check Delivery Charges & Time” button, or by using the “Confirm Delivery Charges & Time” button in the checkout. Estimates for your delivery charges and the receipt of your goods will be confirmed in the checkout process.

5.1 All goods may be delivered via an external courier service or by our own delivery vehicles between 8 am and 10 pm, Monday to Friday (excluding public holidays). Saturday & Sunday deliveries may also be between 8 am and 10 pm.

5.2 Most deliveries will require a signature on delivery meaning someone must be available at the address listed on the order to sign for the goods. If you are not going to be available at the delivery address, please let us know via email or telephone call so we can re-arrange a dispatch date with you.

5.3 You will have received an estimated delivery window at the time of order. We aim to prepare your goods for dispatch of orders within 24 hours of payment (excluding public holidays and weekends). However, we cannot guarantee the courier will be able to collect your items to leave us.

5.4 We will make every effort to ensure goods are delivered within the agreed estimated period that you have chosen when creating the order on this site or via telephone. If this agreement is broken by us, the supplier, a new delivery date will be organised for you, the consumer, with us, the supplier, absorbing any extra cost, you, the consumer will have the option to cancel the order for a full refund. If this is due to you, the consumer, it is then up to you to contact us to re arrange a suitable delivery date and pay any extra cost.

5.5 All goods must be signed for and checked as described in 4.6.

5.6 Goods are delivered to Kerb side and it is up to the consumer to make arrangements to carry the product/s beyond the Kerb. The courier is not contracted to do this.

5.7 All couriers that we use are external and work within their own policies. For any unforeseen damages or missing parts please refer to section 4.7.

5.8 Any Free Delivery promotions will only apply within mainland England, and within a radius of our Melton Mowbray store. Restrictions to specific postcodes will apply and the free delivery promotion will be unavailable to those locations. Items will be despatched based upon an economy service and may take up to 10 working days.


6 WARRANTY

6.1 Warranties are stated on the website for all vehicles on the specific product page.

6.2 All our items are listed with a Manufacturer’s Parts Only Warranty. This means that if there is a fault with the product and you report the fault to us within the time frame of the warranty, we will assess the issues with you and send either parts or arrange the return of the item for repair.

6.3 Warranties do not cover any modifications, whether minor or major or damage caused by the use of noncertified accessories, including battery charges and related electrical spares not supplied by Fun:Bikes and specifically designed for the product, water ingress, user error, misuse, breakages, wear and tear of items, accidental damage or broken parts which may have been caused by the owner / rider.

6.4 Modifications of the vehicle are strictly prohibited and will void any and all warranties related to the product and may render the product unsafe and unfit for use.

6.5 Certified Accessories must be used, including battery chargers and electrically related parts designed specifically for the vehicle only. The use of chargers and electrical components that are not explicitly designed for the product will void the product warranty and may make redundant the safety systems designed into the components of the product. Using non-certified, none product specific accessories and parts may create a fire risk and should not be used in any circumstances.

6.6 For all warranties/faults, we will ask for some evidence of the fault. This could be via photographic or video evidence.

6.7 If an item is required to be returned to us for repair, we will offer to arrange this service. To arrange this, we will send the necessary paperwork to you via email for your attention and correspondence. If the required paperwork is not returned to us for any reason, we will not arrange the collection of the item. If you still wish to return the item for repair, it is your responsibility to return the item as set out in section 4.

6.8 We endeavour to repair all warranty issues within 72 hours. However, as we do not stock all parts for all items here, there may be times where we have to order and wait for the necessary component to arrive. In this instance, it can take up to 6 weeks to complete a warranty repair.

6.9 This section does not affect your statutory rights.


7 WEBSITE LICENSES

7.1 Permission is granted to temporarily download one copy of the materials (information or software) on the web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

7.1.1 modify or copy the materials

7.1.2 use the materials for any commercial purpose, nor for any public display (commercial or non-commercial);

7.1.3 attempt to decompile or reverse engineer any software contained on the web site;

7.1.4 remove any copyright or other proprietary notations from the materials; or

7.1.5 transfer the materials to another person or “mirror” the materials on any other server.

7.2 This license shall automatically terminate if you violate any of these restrictions and may be terminated by the company at any time.

7.3 Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

7.4 Unless stated otherwise all images and videos on this site and owned by us or licensors.


8 SITE ACCESS

8.1 We will always endeavor to have the website available at all times, however if for any reason the website becomes unavailable we are not liable for this, regardless of how long the site is unable to be accessed.

8.2 The access to the site may become limited or unavailable for a temporary amount of time and without notice due to a system failure, maintenance or for any reason that is outside of our control.


9 VISITOR MATERIAL AND CONDUCT

9.1 Apart from any personal information, any material you post to this site will be treated as non-confidential and non-proprietary. We have no obligation to respect such material and we are free to disclose, distribute, incorporate and otherwise use the material as we see fit.

9.2 You are prohibited from posting or transmitting to or from this website any material:

9.2.1 That is of a threating, offensive, indecent, offensive, pornographic, abusive, demeaning, that implies racial hatred, that is blasphemous, discriminatory, in breach of other parties’ confidence, in breach of privacy or may cause distress or harm to others.

9.2.2 Any documentation or material that you have not had a license to use,

9.2.3 Any documentation or material that encourages or is considered to be a criminal offence in the United Kingdom, or

9.2.4 That is technically harmful to the website. Examples of these are viruses, Trojans and Malicious software.

9.3 You are prohibited from misusing the website, including hacking.

9.4 We will fully co-operate with any law enforcement agency, or by court order and request, or by the disclosing of information of persons breaching terms 9.2 and 9.3

10.1 Links to third party websites are there for your convenience and ease. If you use any links on our website, you are leaving this site and as such no longer deemed to be covered under our terms and conditions. We have not reviewed any terms and conditions those sites may have and do not accept any liability for any issues caused whilst using that site. All links provided are used at your own risk.

10.2 Any links to this website must follow these conditions:

10.2.1 You do not imply that we endorse any product other than the items listed on this site.

10.2.2 You do not misrepresent your relationship with nor present any other false information about this site,

10.2.3 You do not use our logo or name without our permission,

10.2.4 You do not abide by the information shown in sections 9.2 and 9.3

10.3 We have the right to remove any links to our site that do not abide by the statements in 10.2


11 REGISTRATION

11.1 To register with www.funbikes.co.uk you must be eighteen or over.

11.2 An account is for a single user only, and we do not allow sharing account details with mutable people or networks.

11.3 Responsibility with the security of your password is yours and if you suspect that there has been a breach of your account or that someone may know your details please change your log-in details or contact us via email or telephone.

11.4 We have the right to suspend or cancel any account with us at our discretion or if there is any breach of these terms and condition listed.


12 GOVERNING LAW

12.1 These terms and conditions shall be construed under English Law and do not affect your statutory rights. Disputes arising of these terms and conditions shall be subject to the jurisdiction of the English courts.

12.2 We do not warrant any items on this website are appropriate and/or available for purchase and use outside the United Kingdom. If you access this website from outside the United Kingdom you do so at your own risk and you are responsible for complying with your county’s laws.


13 LEGAL DECLARATION AND DISCLAIMER

13.1 All of the Bikes, Quads, Buggies and Scooters on this site are listed for NON ROAD LEGAL use (unless the description states otherwise) and should under no circumstance be used on public roads. If you purchase an item from us, it is your responsibility how you use the item and we are not liable for any government laws enforced upon you or the product.

13.2 Officially Mini Moto Products are designed for ages 12 years and over, however it is down to parent discretion on the suitability of the product for the intended rider.

13.3 We always recommend that safety gear is worn when riding the item and that there is Adult Supervision at all times.

13.4 The customer accepts FULL responsibility and releases FunBikes Limited from all loss, costs or damage incurred because of the customers misuse, wear and tear and customers self-build of the product. It is the customer’s responsibility to maintain the safety of any product brought through this site or over the phone with this company. This clause does not affect your statutory rights and does not restrict the customer’s rights in respect of any personal injury or death.

13.5 Product specifications are subject to change without notice and may vary from those shown. Errors and omissions excepted. We will always use best endeavours to ensure specifications are correct and up to date. However, to improve our products performance, reliability, safety and general use for our customers, products specifications may be amended without notice.

13.6 While we endeavour to ensure products on our website accurately match the real world product you receive, due to several factors, the hue and/or shade may differ slightly from what is pictured.


14 RECOMMENDATIONS

14.1 We strongly advise that the customer or someone they know have good mechanical knowledge who can carry out any servicing, general maintenance or repairs on any mechanical product bought from this site. You should expect to have to change parts on any of these products over time and we would expect that you the customer will be able to carry out these repairs. We strongly recommend if you are unable to do so or do not know someone with the capability to do these checks and repairs that you do not purchase these items from this site.


15 COMMENTS & COMPLAINTS PROCEDURE

15.1 If you are not satisfied with our products or service for any reason, please speak first to our Customer Services team, and they will attempt to resolve the issue immediately whenever possible.

When possible, please use your registered email address, this will create a Ticket and reference ID number and allow us to make notes of your issues and view any case history within your account. Our Customer Services team will generally respond within 24hrs or 48hrs in very busy times.

Our Customer Service lines are recorded and monitored for quality and training purposes. You will need your registered email address, registered phone number, or Order Number and the postcode of your account to enable us to locate your details and make relevant notes.

If you do not feel that your matter has been adequately dealt with, our Customer Services representative will advise if your issue may be escalated, or recommend your issue is escalated, to the business manager, who will further attempt to resolve your complaint.
